By accessing or using MindfulEcho, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you may not use the Service.

If you are using MindfulEcho through an organization, employer, or other partner, you agree to these Terms on your own behalf and as permitted by that organization's policies.

MindfulEcho is a private mental wellness platform that lets you record video and audio journal entries, receive AI-generated reflections and mindset shifts, complete optional mental health self-assessments, track your mood and thinking patterns over time, and participate in guided coaching challenges.

The Service is designed to support self-reflection and personal growth. It is a wellness tool and is not a medical device, a clinical service, or a substitute for professional mental health care.

You must be at least 18 years old to use MindfulEcho. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. If you believe your account has been compromised, contact us promptly. You may not share your account with others or create an account on someone else's behalf without authorization.

"Content" includes your video and audio journal entries, titles, tags, mood reports, assessment responses, coaching goals, feedback, and any other material you submit to the Service.

You retain ownership of your Content. By submitting Content to MindfulEcho, you grant us a limited license to host, store, process, and analyze your Content solely to provide and improve the Service for you — including generating AI reflections, pattern insights, and progress reports.

You are responsible for your Content. You represent that you have the right to submit it and that it does not violate any law or third-party right. You may delete your Content at any time within the app, which removes it from your active account.

You agree not to use MindfulEcho to:

• Violate any law, regulation, or third-party right
• Harass, abuse, threaten, or harm another person
• Submit content that is unlawful, harmful, hateful, or infringing
• Attempt to gain unauthorized access to the Service, accounts, or systems
• Interfere with or disrupt the Service or its security features
• Reverse engineer, decompile, or extract source code or proprietary models
• Use the Service for any commercial purpose without our permission
• Share your account access with others

We may suspend or terminate access if we believe you have violated these rules or otherwise harmed the Service or its users.

MindfulEcho uses artificial intelligence to generate reflections, mindset shifts, cognitive distortion analysis, pattern alerts, and predictive insights based on your journal entries. These outputs are generated by automated systems and are informational and reflective in nature.

AI insights may be incomplete, inaccurate, or not applicable to your situation. They are not professional advice and should not be relied upon for medical, psychological, legal, or financial decisions. You are responsible for how you interpret and act on any AI-generated content. If you are experiencing a mental health crisis, contact a licensed professional or emergency services.

Some features of MindfulEcho may require a paid subscription. Subscription fees, billing cycles, and plan details are displayed at the time of purchase. By subscribing, you authorize us to charge the selected payment method through our payment processor (Stripe) until you cancel.

You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle. Fees are non-refundable except where required by law. We may change our fees or plans with reasonable advance notice; any price change applies to future billing cycles.

MindfulEcho, including its software, design, prompts, frameworks, branding, and AI models, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or proprietary content except as needed to use the Service for your personal wellness.

You may not copy, modify, distribute, or create derivative works from the Service without our written permission. Your Content remains your property as described in Section 4.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that AI-generated insights will be accurate or reliable.

To the fullest extent permitted by law, we disclaim all warranties regarding merchantability, fitness for a particular purpose, and non-infringement. MindfulEcho is a wellness and self-reflection tool and is not a medical or clinical service.

To the fullest extent permitted by law, MindfulEcho and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months preceding the claim, or, if you have not paid us, to a nominal amount. This limitation applies even if we were advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations or exclusions, so some of the above may not apply to you.

You may stop using MindfulEcho and delete your account at any time. You can request account deletion by contacting us.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if you violate these Terms or we believe doing so protects the Service or its users. Upon termination, your right to use the Service ends. Sections that by their nature should survive — including intellectual property, disclaimers, and limitation of liability — remain in effect.

We may update these Terms from time to time. When we make material changes, we will update the "last updated" date and, where appropriate, notify you within the app. Your continued use of MindfulEcho after changes take effect means you accept the updated Terms.
